Seattle DWI Lawyer

DUI Process

You know how serious a DUI conviction can be. But what is the process behind DUI arrests and convictions? What do you need to know about the Washington DUI process before you go to court? Read on for more information on the DUI process and finding the right DUI lawyer.

The Arrest: The arrest is the first portion of the DUI process. Be sure to remain calm and polite during your arrest. Immediately upon release or even before, contact a competent DUI defense attorney to help you with the next steps.

The Arraignment: Your next brush with the law will be during an arraignment, an appearance before the court in which you are informed of your charge, your rights, and given a chance to plead not guilty. The arraignment is also where your trial dates are set and where you find out who your lawyer is. This is a point in the process when your Seattle DUI lawyer may wish to bring objections or venue complaints before the court.

The DOL (Department of Licensing) Hearing: Washington state DUI cases have two prongs: the criminal and DOL prongs. The DOL hearing must be scheduled for within 30 days of your arrest and requires a fee of its own.

The Discovery Process: Once your trial date is set, your attorney will begin the discovery process. This involves gathering all potential evidence in your case, including reviewing appropriate documents and making demands of the prosecutor for additional documentation.

Pre-Trial: A pre-trial conference is usually ordered to get both sides in one place and sort out any remaining issues. Your lawyer may wish to discuss a plea bargain or other agreement at this point.

Hearing and Sentencing: Your hearing or trial occurs next. If you are found guilty, the sentencing process begins after the guilty verdict has been entered. Sentencing may occur during or after your trial.

Given the complexity of the DUI process and the many potential pitfalls, finding the right DUI lawyer is of the utmost importance.
